Clarity terms of service
Clarity is a service of Lumos Intégrité Inc. (“Lumos”, “we”), available at clarity.lumos.property. By ticking the box provided or by using the service, you accept these terms and our Privacy Policy, which forms part of them. We wrote them to be read, not only to be legal.
1. What Clarity does, and does not do
Clarity reads the pre-purchase inspection report you upload and hands you a written analysis: an overall score, priority lists, cost ranges, a negotiation strategy, questions for your inspector and an overall opinion. Every point references the page of the report it comes from.
Clarity is an aid to understanding. Clarity does not visit the house, observes nothing by itself and replaces neither your building inspector nor a contractor, lawyer, notary, broker or any other professional. The analysis is not professional, legal, financial or technical advice.
Amounts shown are orders of magnitude based on regional averages. They are neither quotes nor estimates from a contractor. Real costs depend on the house, the contractors and the timing; have them confirmed before you commit.
The analysis is produced by artificial-intelligence models, framed by our rules and checked by automated controls. Despite those controls, an error, an omission or a misreading remains possible. The decision to buy, negotiate or walk away is yours and remains your sole responsibility.
2. Your report and your commitments
By uploading a report, you confirm:
- that you are the client of the inspection or otherwise have the right to use this report for this purpose;
- that the file is an authentic, unaltered inspection report;
- that you use Clarity for personal purposes, in a real-estate transaction that concerns you;
- that you are at least 18 years old.
You may not circumvent our security measures, automate bulk uploads, resell the analysis or use the service to infringe the rights of others, including those of the inspector who authored the report.
3. Price, payment and refunds
The price is the one displayed at the time of purchase, taxes included, paid once per report, with no subscription. Payment is processed by a third-party payment provider; we never see or store your card number.
You are refunded in full, without any request, if Clarity detects that the uploaded file is not a readable inspection report and stops the analysis.
Accuracy guarantee: if you show us, with evidence, that Clarity got its analysis wrong or that the analysis is not relevant to your report, we refund 100%. Write to support@lumos.property within thirty (30) days of the analysis, with the link to the analysis and the item in question. We check and refund within ten (10) business days.
These guarantees are in addition to, and do not limit, the legal warranties provided by the Quebec Consumer Protection Act (CQLR, c. P-40.1) and the Civil Code of Québec.
4. The link to your analysis
Your analysis is available through a private link sent to your email. The link is not indexed by search engines, but anyone who holds it can view the analysis. You are responsible for how you share it. On request, we disable a link.
5. Intellectual property
The inspection report remains the property of its author and of you. You grant us a limited, non-exclusive licence to process it in order to produce your analysis, run the service and improve Clarity, under the conditions described in the Privacy Policy.
The analysis is delivered for your personal use. You may share it with the people helping you with your purchase (broker, partner, contractor, advisor). Clarity, its texts, code, trademarks and method remain the property of Lumos.
6. Liability
We undertake to provide the service diligently. To the extent permitted by law, the service is provided “as is” and we do not warrant that it will be error-free or available without interruption.
To the extent permitted by law, Lumos is not liable for decisions you make based on the analysis, for differences between the ranges shown and actual costs, or for indirect damages (lost opportunity, financial loss, delayed transaction). Except in cases of intentional or gross fault, Lumos’s total liability to you is limited to the amount you paid for the analysis concerned.
Nothing in these terms limits the rights granted to you by the public-order provisions of the Consumer Protection Act or the Civil Code of Québec.
7. Personal information and communications
How we collect and use your personal information is described in our Privacy Policy. We send you the emails the service requires (confirmation, link to the analysis, receipt, reply to a request). Tips and news emails are sent only with your consent, in accordance with Canada’s Anti-Spam Legislation, and each contains an unsubscribe link. If you upload a report without completing the payment, we may send you up to two reminders, each with an unsubscribe link.
8. Changes, governing law and contact
We may change these terms; the version in force is the one published on this page, with its date. A material change is announced on the site before it takes effect. It does not apply retroactively to an analysis already paid for.
These terms are governed by the laws of Quebec and the laws of Canada applicable therein. Any dispute falls under the courts of Quebec. If you are a consumer, you keep the right to bring the remedies provided by law before the court of your district.
The French and English versions have equal value; in case of discrepancy, the French version prevails.
